BILL NUMBER: S6239 SPONSOR: SAVINO TITLE OF BILL: An act to amend the executive law, in relation to the authority of the New York black car operators' injury compensation fund, inc. PURPOSE OR IDEA OF GENERAL BILL: This legislation makes a technical change to clarify the authority of the Workers' Compensation Board with regard to its ability to provide benefits consistent with its plan of operation to ensure that 140,000 black car drivers continue to have the availability of vision, telemedi- cine and other insurance benefits. In 1999 New York State, with the support of the International Associ- ation of Machinists, the AFL-CIO, and the owners of black car companies, created the Black Car Fund to provide workers compensation insurance for black car operators paid for with a surcharge on every black car ride. The fund now covers over 140,000 black car operators around the state including all Uber and Lyft drivers with a surcharge of 2.5%.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 160-ii of the executive law is amended by adding a new subdivision 5 to read as follows: 5. THE FUND SHALL HAVE THE AUTHORITY TO PROVIDE ADDITIONAL BENEFITS, CONSISTENT WITH ITS PLAN OF OPERATION, FOR ALL BLACK CAR OPERATORS ENTI- TLED THERETO PURSUANT TO THIS CHAPTER, PROVIDED THAT THE FUND SHALL HAVE COMPLIED WITH ALL APPLICABLE STATUTORY AND REGULATORY REQUIREMENTS. THE SURCHARGE AMOUNT NOT RELATED TO PAYMENTS OF WORKERS' COMPENSATION CLAIMS AND THE ADMINISTRATION OF THOSE CLAIMS SHALL BE ONE-HALF OF ONE PERCENT (0.5%). § 2.
