The Post University (“Post”, “we”, “our”, or “us”) Website officially describes certain aspects of the Post’s business, student services, and overall brand.  Due to the importance of the information communicated on Post’s website and the confidentiality of information submitted through the website, Post maintains information security measures and controls appropriate to the sensitivity of the information we process.

Post respects the privacy of your information and protects against its unauthorized access, use, or distribution. This Privacy Policy is designed to assist you in understanding how we use and safeguard the information you provide to us in using any of our post.edu websites or any of our mobile applications (collectively the “Site”) and the services provided through our Site (the “Services”). Please read this Privacy Policy carefully. By using this Site, you acknowledge and agree that you consent to this Privacy Policy.  Residents of California should view the California Privacy Rights section, below, for more information about how we collect and process the personal information of California residents.

INFORMATION WE COLLECT

Through your use of our Services and Site, we may collect limited personal information, which is information that identifies you as an individual, relates to you as an identifiable individual or, that along with other information, could identify you (“Personal Information”). We collect the following types of Personal Information: Name, address, phone number, email, date of birth, Social Security number, student identification number, username, password, credit or debit card information, education history, citizenship, military status, your feedback and your preferences.

Information provided by you.

We do not require you to provide any Personal Information in order to navigate our Site. However, we need to collect Personal Information if you choose to engage in certain activities on our Site. We may collect Personal Information from you when you:

  • Register for an online service. When you register for an online service, including email list serves and newsletters, you will provide us with your name, address, and phone number.
  • Order merchandise.When you purchase merchandise on our Site, you will provide payment card information, such as name, credit or debit card number, expiration date, and CVV.
  • Create an account. If you create an account to utilize the Services, you will provide us with your name, phone number, address, and email.
  • Request information regarding one of our programs. When you request information on one of our programs, you will provide your name, address, phone number, email, program of interest, location of interest, and military status.
  • Sign up for a tour of our campus. When you sign up to take a tour of our campus, we will collect your name, email, and phone number.
  • Apply to a program. When you apply to one of our programs, you will provide information which may include your name, address, date of birth, Social Security number, phone number, citizenship, education history, FAFSA funding information, criminal history, relevant medical information, and/or your military status.
  • Use Post registration sites. If you use one of our registration sites, such as the Library, Student, or Faculty Webs, you will need to provide your username, address, email address, Social Security number, and student identification number.
  • Interact with our Site or Services. When you send us any feedback, questions, comments, suggestions, ideas, or interact with us in any way, you may need to provide us with your name and contact information.

Information collected automatically.

We may automatically collect the following types of Personal Information as you use our Site or Services:

  • Usage Information. Which pages on our Site you access, the frequency of access, what you click on while on our Site, and when you accessed the Site. Usage Information may include session replay information that allows us record and better understand how you interact with our Site and Services. This information may be disclosed to third party service providers who help us analyze and understand the information.
  • Location Information. Information about your location, which may be determined through your IP address.
  • Device Information.Information about the device you are using, such as hardware model, operating system, browser, and IP address.

Cookies and other tracking technologies.

We may send one or more cookies to your computer or other device.  We may also use other similar technologies such as tracking pixels, tags, or similar tools when you visit our Services.  These technologies can collect data regarding your operating system, browser type, device type, screen resolution, IP address, and other technical information, as well as navigation events and session information as you interact with our Services.  This information allows us to understand how you use the Services.

HOW WE DISCLOSE YOUR INFORMATION.

We may disclose your Personal Information for the following purposes:

  • Service Providers.We may disclose Personal Information to the service providers that help us perform the Site functions, as described above. We may also disclose your Personal Information to service providers that help us provide you with the Services, such as processing your transactions and providing you with educational materials. In particular, we may utilize the following service providers to provide you with the Services:
    • Campus Management: We use Campus Management to manage student records. Campus Management’s privacy policy can be found here.
    • Microsoft: We use Microsoft for email services. Microsoft’s privacy policy can be found here.
    • Blackboard: We use Blackboard for online learning services. Blackboard’s privacy policy can be found here.
    • Ready Education: We use Ready Education for our mobile apps. Ready Education’s privacy policy can be found here.
  • Corporate Structure.We may disclose Personal Information if we are involved or intend to be involved in a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or in connection with bankruptcy or liquidation proceedings.
  • To Prevent Harm.We may disclose Personal Information if we believe it is necessary in order to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.
  • To Protect Our Rights and As Required by Law. We will disclose Personal Information where we are legally required to do so, such as in response to court orders or legal process, to exercise our legal rights, to defend against legal claims or demands, or to comply with the requirements of any mandatory applicable law. We will also disclose Personal Information as necessary to enforce any other terms that you have agreed to, including to protect the rights, property, or safety of Post, its users, or any other person, or the copyright-protected content of the Services.
  • With Your Consent. We will request your permission to use or disclose your Personal Information for a specific purpose that is not compatible with the purposes listed here. We will notify you and request consent before you provide the Personal Information or before the Personal Information you have already provided is disclosed for such purpose.

CHOICES ABOUT YOUR INFORMATION

  • Do Not Track. Unless you are a resident of California implementing the Global Privacy Control (discussed in the California Privacy section, below) we take no action in response to “Do Not Track” requests received from users’ web browsing software.
  • Cookies and Tracking Technologies. If you would like to opt-out of accepting cookies altogether, you can generally set your browser to not accept cookies or to notify you when you are sent a cookie, giving you the chance to decide whether or not to accept it. However, please note certain features of our Site or other services may not work if you delete or disable cookies.
  • Online Advertising. You may opt-out of certain types of interest-based advertising or learn more about the use of this information by our service providers by visiting the Network Advertising Initiative website (http://www.networkadvertising.org/managing/opt_out.asp) or the Digital Advertising Alliance website (http://www.aboutads.info/choices/), or if you are in the EU, the EDAA (http://www.youronlinechoices.eu/). RETENTION OF YOUR PERSONAL INFORMATION

We will retain your Personal Information until the Personal Information is no longer necessary to accomplish the purpose for which it was provided. We may retain your Personal Information for longer periods for specific purposes to the extent that we are obliged to do so in accordance with applicable laws and regulations, to protect you, other people, and us from fraud, abuse, an unauthorized access, as necessary to protect our legal rights, or for certain business requirements.

SECURITY

We maintain commercially reasonable security measures to protect the Personal Information we collect and store from loss, misuse, destruction, or unauthorized access. Our security includes industry-standard physical, administrative, and technology-based measures. However, no security measure or modality of data transmission over the Internet is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolutely security.

EUROPEAN, UNITED KINGDOM, AND SWISS USERS

This section of our Privacy Policy provides certain required information to persons located in the European Union (“EU”), a European Economic Area (“EAA”) member state, the United Kingdom, or Switzerland. Before Post collects certain Personal Information from you, you are entitled under the EU General Data Protection Regulation (“GDPR”) to the information in this section of our Policy.

Purposes and Legal Basis for Processing Personal Information

Post will only process your Personal Information for lawful purposes under the GDPR related to Post’s business purposes arising from your relationship with the Post. Post will ordinarily collect and process your Personal Information because it is necessary for the performance of a contract to which you are a party or because Post has another legitimate interest in doing so. When Post cannot rely on either of such legal grounds, it will seek your prior consent.

Rights of Residents of the EU, UK, and Switzerland

If you use the Site and reside in the EU, EAA, UK, or Switzerland, you are entitled by law to access, correct, amend, or delete Personal Information about you that we hold. A list of these rights is below. Please note that these rights are not absolute and certain exemptions apply.

  • The right to access. You have the right to ask us for copies of your Personal Information. This right has some exemptions, which means you may not always receive all the Personal Information we collect and process. When making a request, please provide an accurate description of the Personal Information you want access to.
  • The right to rectification. You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • The right to erasure.You have the right to ask us to erase your Personal Information in certain circumstances, including: (i) when your Personal Information is no longer necessary for the purposes for which it was collected or processed, or (ii) your Personal Information must be erased to comply with a legal obligation in EU Union or Member State law.
  • The right to restrict processing. You have the right to ask us to restrict the processing of your Personal Information in certain circumstances, including: (i) when the accuracy of the Personal Information is brought into question, or (ii) when we no longer need the Personal Information for purposes of the processing but you require such Personal Information for the establishment, exercise, or defense of a legal claim.
  • The right to object to processing.You have the right to object to processing of your Personal Information.
  • The right to data portability. You have the right to ask that we transfer the Personal Information you gave us from one organization to another, or give it to you.
  • The right to lodge a complaint with the supervisory authority.If you believe your rights under the GDPR have been violated, the GDPR gives you the right to file a complaint with the supervisory authority. Right to Withdraw Consent

Cross-Border Transfers of Personal Information

Personal Information that you provide while in the EU, EAA, UK, or Switzerland will be transferred to the United States. When transferring Personal Information to and processing Personal Information in the United States, we will implement appropriate safeguards and process the Personal Information in accordance with the terms of this Policy. By using our Site or otherwise providing your personal information, you agree to the transfer and processing of your Personal Information to the United States.

CALIFORNIA PRIVACY RIGHTS

If you are a California Consumer, you have certain rights with respect to the collection, use, transfer, and processing of your “Personal Information”, as defined by the California Consumer Privacy Act and California Privacy Rights Act (collectively the “CCPA”). We reserve the right to limit these rights where permitted under applicable law, including where your identity cannot be reasonably verified or to the extent your rights adversely affect the rights and freedoms of others. To exercise any of the rights below, please contact us via the contact information below. Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.

Collection of Personal Information

We have collected the following categories of Personal Information (as defined by the CCPA) from California Consumers that access the Post Site and Services in the past 12 months:

We collect this information directly from you.
D. Commercial Information Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies. We collect this information by logging your interactions with our Services.
F. Internet or Other Similar Network Activity Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement. We collect this information by logging your interactions with our Services.
G. Geolocation Data Physical location or movements. We collect this information by logging your interactions with our Services.
I. Professional or Employment-Related Information Current or past job history or performance evaluations, title, employment history, salary, performance reviews, resumes, 401k Contributions, and background checks. We collect this information directly from you.
J. Education Information Information that is not publicly available personally identifiable information as defined under the Family Educational Rights and Privacy Act.  
K. Inferences Drawn of the Consumer Inferences drawn from Personal Information identified above to create a profile about a consumer reflecting a consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. We collect this information by logging your interactions with our Services.
L. Sensitive Personal Information

Information revealing a government identification number; account login credentials; financial account, credit, or debit card information in combination with any required security or access code; and precise geolocation information.

Some categories of sensitive personal information may overlap with other categories defined under California law.

We collect this information directly from you.

 

Business or Commercial Purposes for which Personal Information is Collected

Your Personal Information is used for the following purposes:

  • Register for an online service;
  • Order merchandise;
  • Create an account;
  • Request information regarding one of our programs;
  • Process your application;
  • Use Post registration sites;
  • Interact with our Site or Services;
  • Provide you with the products and services you request, view, engage with, or purchase;
  • Communicate with you regarding your account or transactions with us;
  • Send you offers and promotions for our products and services;
  • Provide you with targeted advertising based on your activity on our sites;
  • Operate, understand, optimize, develop, or improve our sites, applications, products, services and operations;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
  • Debugging to identify and repair errors that impair existing intended functionality;
  • Investigate and prevent activities that may violate our policies; and
  • Fulfill our duties as an employer.

How We Disclose Your Personal Information

In the preceding 12 months, we have disclosed the following categories of personal information about consumers for business purposes:

  • We disclose personal information in categories A (identifiers), B (personal), C (protected class), D (commercial), F (internet), G (geolocation), I (professional), J (educational), K (inferences), and L (sensitive) with service providers.
  • We disclose content posted on our social media platforms (e.g., if a consumer “comments” on a story) with other consumers. Such posts may include personal information in categories A and B, but the content depends on the individual posts.

In the preceding 12 months, we have shared for cross-contextual advertising the following categories of personal information about consumers:

  • We have shared personal information in categories A (identifiers), B (personal), D (commercial), F (internet), and G (geolocation) to third parties so that they can market products, information, campaigns, or services to you.

In the preceding twelve (12) months, we have not sold the personal information of any consumer for monetary consideration. But, our use of cookies and other tracking technologies may be considered a sale of personal information under the CCPA.  Categories of personal information that we have sold under the CCPA include identifiers (e.g. IP addresses), commercial information (e.g. purchase history), and Internet or other similar network activity information. Categories of third parties to whom personal information is sold under the CCPA include data analytics providers and marketing providers.

You can opt out of our tracking technologies for analytics and advertising service providers by clicking the Do Not Sell or Share My Personal Information link or by broadcasting the GPC signal during your browsing session.  Please note that your use of our Site may still be tracked by Post and its service providers.

In the preceding 12 months, we have not knowingly sold or shared Personal Information about children under the age of 16. We do not process sensitive personal information, as defined under the CCPA, for purposes other than those specifically authorized in Section 7027 of the CCPA regulations.

How We Retain Your Personal Information

We retain your personal information for as long as is necessary for fulfilling the processing purposes identified in this Policy.  Generally, we retain your information for as long as we have a relationship with you and, after our relationship with you has ended, if there is an ongoing business need to retain it.  This includes retention to comply with our legal, regulatory, tax, accounting and/or billing and collection obligations, to resolve disputes, enforce our policies and establish, exercise and defend our rights and any claims.

We will delete your personal information when it is no longer necessary for the purpose for which it was collected, or upon your request, subject to exceptions as discussed in this policy or under applicable law, contract, or regulation.

California Rights

Right to Know About Personal Information Collected, Disclosed, or Sold
You have the right to request that Post disclose the Personal Information it collects, uses, and discloses about you to third parties. There are two types of Right to Know requests you can make:

  • Right to Know (Abbreviated Request): If you make a Right to Know (Abbreviated Request), you will receive the following information about you:
    • Category of personal information collected,
    • Categories of sources from which that information was collected,
    • The business or commercial purpose(s) for which the information was collected,
    • The categories of third parties to whom Post sold or disclosed the category of personal information for a business purpose, and
    • The business or commercial purpose for which Post sold or disclosed the category of personal information.
  • Right to Know (Specific Pieces of Information Request): If you make a Right to Know (Specific Pieces of Information Request), you will receive the following information about you:
    • Specific pieces of Personal Information collected about you.

This information will be provided to you free of charge, unless Post determines that your request is manifestly unfounded or excessive. You may request this information twice in a 12-month period.

There are certain exceptions to a consumer’s Right to Know.  We will state in our response if an exception applies.

Right of Deletion
You have the right to request that Post and our service providers delete any Personal Information about yourself that Post has collected from you upon receipt of a verifiable request. This right is subject to exceptions. We will state in our response if an exception applies.

Right of Correction
If we maintain inaccurate personal information about you, then you have the right to request that we correct the inaccurate personal information upon receipt of a verifiable request. This right is subject to exceptions. We will state in our response if an exception applies.

Right to Opt-Out of the Sale or Sharing of Personal Information
You have the right to opt-out of the sale or sharing of your personal information by a business subject to certain laws and regulations. As described above, although we do not sell your information for monetary consideration, our use of online trackers and cookies may constitute a sale or sharing under California law.  Therefore, we allow you to opt-out of our use of these online trackers through our Do Not Sell or Share My Information page.

We recognize the Global Privacy Control.  Your browser must be able to support the Global Privacy Control for us to recognize your opt-out preference signal.

Please note that opt-out choices may be stored via cookies.  If you clear cookies, if your browser blocks cookies, or if you view the page from a different browser or device, your opt-out choice may no longer be logged or recognized.

Right to Limit Use and Disclosure of Sensitive Personal Information
If we collect Sensitive Personal Information (as defined in Cal. Civ. Code § 1798.140(ae) (effective Jan. 1, 2023)) about you with the purpose of inferring characteristics about you, then you have the right to request that we limit the use of such information to the use which is necessary to perform the services we offer or for other permitted purposes under Cal. Civ. Code § 1798.121 (effective Jan. 1, 2023) upon receipt of verifiable request. But, we do not process any sensitive personal information in a manner not specifically authorized by California law.

Submitting Requests

Verifying Requests

Post provides California Consumers with the ability to submit requests through our request website, our telephone number, and our email address. Post must verify that the person requesting information or deletion is the California Consumer about whom the request relates in order to process the request.  To verify a California Consumer’s identity, we may request up to up to three pieces of Personal Information about you when you make a request to compare against our records.  We cannot respond to your request or provide you with Personal Information if we cannot verify your identity. Making a verifiable consumer request does not require you to create an account with us. However, we may require that you access a previously existing account where necessary to complete the request. We will only use Personal Information provided in your request to verify your identity and will delete any information you provide after processing the request. Post reserves the right to take additional steps as necessary to verify the identity of California Consumers where we have reason to believe a request is fraudulent.

Authorized Agent

You may choose a person registered with the California Secretary of State that you authorize to act on your behalf to submit your requests (“Authorized Agent”). If you choose to use an Authorized Agent, Post requires that you provide the Authorized Agent with written permission to allow them to submit your request and that you verify your identity directly with Post. Failure to do so may result in Post denying your request.

Right to Equal Service and Nondiscrimination

Post will not discriminate against you because you exercised any of your rights, including, but not limited to, by:

  • Denying goods or services to you.
  • Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
  • Providing a different level or quality of goods or services to you.

Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

THIRD PARTY LINKS

The Site may contain links that will let you leave the Site and access another website. Linked websites are not under our control. This Privacy Policy applies solely to Personal Information that is acquired on this Site. We accept no responsibility or liability for these other websites.

CHANGES TO THIS PRIVACY POLICY

Personal Information refers to information we hold that relates either directly or indirectly to you. Please note that the specific pieces of information that we collect about you may vary due to the nature of your position, role, and benefits. We generally collect information directly from you. However, we may collect certain categories of information from service providers, such as recruiting firms, application processors, and background check providers, where necessary and appropriate to facilitate the employment relationship.

(a) Administering the Employment/Contractor Relationship

We keep and process Personal Information for traditional employment and contractor engagement purposes. In certain contexts, this may include visa sponsorship information. We use this information for management and administrative uses and only disclose it with others who have a need-to-know such information. We keep and use it to enable us to run the business and manage our relationship with you effectively, lawfully and appropriately, during the recruitment process, while you are working for us, and after your employment or contract has ended. This includes using Personal Information to enable us to comply with any legal requirements associated with an employee or contractor relationship, to administer payroll, to provide you with benefits, ensure your safety, comply with an employment or service contract, and to demonstrate our commitment to equal employment opportunity and fair employment practices.

As a basic commitment, all Post associates can expect to be paid correctly in accordance with University policies and legal requirements (local, state, or federal); therefore, Post’s access and time recording systems record work absences and justification for absences. Relatedly, we may process certain health or medical related information, such as doctor’s notes or disability information, in order to provide appropriate protections and benefits.

(b) Compliance with Legal Obligations

In certain situations, we may need to collect and process your Personal Information to comply with our legal obligations. This may include:

  • Tracking demographic information to confirm compliance with equal opportunity and non-discrimination policies and requirements;
  • Processing information relating to your health, which could include reasons for absence and doctor’s reports and notes, in order to comply with our obligations under applicable employment and safety and health laws;
  • Verification of employment;
  • Maintenance of tax records and unemployment or disability insurance coverage;
  • Processing information regarding certifications and qualifications for your role or position;
  • Processing information regarding participation in employment related activities about which we are required to retain a record; and/or
  • Processing information relevant to any alleged violations of the law or Post internal standards or in compliance with a subpoena or other valid legal or regulatory request.

(c) Facilitate Communications and Efficiency

Post uses various tools and platforms that enable you to more easily communicate with other personnel and to more efficiently access and disclose various types of work product. Some tools may also allow personnel to disclose information via social media or other channels, including information relating to job opportunities.

These tools and platforms may collect and disclose contact information and company profile pictures; log certain preferences and actions; collect your geolocation; and create user profiles that allow personnel and Post to track their efficiency and performance. We may also have access to communications sent using Post systems and devices. Therefore, personnel do not have a reasonable expectation of privacy in such communications.

(d) Provide Benefits

We may offer a variety of benefits depending on your relationship with us. We, or our service providers, collect any information necessary to provide these benefits, as described in the chart above. If Employees take advantage of other benefits, such as fitness-related benefits, we may also collect additional biometric and sensory information relating to these activities, as would be required to effectuate these benefits. When you participate in certain benefits programs, we may also generate a log of your activity, track internet and other network activity, and develop a user profile to provide those programs to you in a manner tailored to your preferences.

All benefits may not be available to all personnel, and the Post will only collect Personal Information to provide a benefit if you are eligible for and enrolled in that benefit. You should take care to read the specific terms applicable to any particular mobile application or benefits program to understand the specific pieces of information collected.

(e) Ensure the Safety of Employees, Contractors, Facilities, Property, and Systems

We collect various categories of Personal Information to ensure the safety of personnel, facilities, property, and systems. This information helps verify the identity of personnel in specific facilities and ensure the security of facilities and Post property. This may include the collection of certain health, vaccination, or screening information when individuals enter our facilities.

Additionally, we may process certain categories of Personal Information to ensure the safety and security of our electronic systems and devices. This may include the automated monitoring of our systems for suspicious or fraudulent activity and other forms of illegal conduct. It may also involve the automated or manual review of conduct that may be deemed suspicious or otherwise in violation of Post policies or procedures. This monitoring is to ensure the safety and security of our systems and the confidential information that is entrusted to us.

II. How Your Personal Information Is Disclosed

Your Personal Information will be disclosed primarily to Post staff for purposes of processing your employment application or administering the employee / contractor relationship. We may also disclose your Personal Information to the following third parties or for the following purposes:

  • With Our Service Providers. We may share your Personal Information with our service providers that support our human resources and hiring functions, such as external recruiting services, background check providers, assessment providers, and reference check providers.
  • To Improve Our Services. We may occasionally use consultants, experts, or other advisors to assist in fulfilling our obligations and to help run the university properly.

We enter into written contracts with our service providers to ensure the privacy and security of your Personal Information. Under these contracts, we restrict the access to and processing of your Personal Information to that which is necessary for the purpose of the disclosure.

In certain circumstances, we may provide you with opportunities to sign up for certain benefits programs that involve the disclosure of your Personal Information to third party benefits providers. In the preceding 12 months, we have not sold or shared employment related Personal Information to third parties for money or anything of monetary value. To the extent that personnel use our website, such use may be subject to the terms of the general Privacy Policy above.

We do not collect, process, or disclose sensitive personal information, as defined under California law, for purposes other than those specifically authorized in under applicable law.

We may collect certain information regarding the family members of personnel for the purposes of providing benefits. In some circumstances, this may include information about individuals under 16 years of age. In no circumstances do we sell or share information regarding children under 16 years of age. In no circumstances do we process such information for any purpose other than for purposes reasonably associated with providing the relevant benefits.

IV. How Long We Retain Your Personal Information

We retain your Personal Information until the Personal Information is no longer necessary to accomplish the purpose for which it is was provided. However, we may retain your Personal Information for longer periods for specific purposes to the extent we are obliged to do so in accordance with applicable laws and regulations, as necessary to protect our legal rights, and/or for certain business requirements. Post University maintains highest regard for the confidentiality of students’ personal information that may be obtained at any time as part of Post’s business processes. This Privacy Notice is designed to supplement the Post Website Privacy Policy, available here, which explains our collection of personal information through our website and other online services. This notice contains additional information about how and why Post collects Personal Information from students and what we do with that information.

I. Student Personal Information We Collect

Personal Information is any data that identifies you as an individual, relates to you as an identifiable individual, or that, along with other information, could identify you (“Personal Information”). The Personal Information that Post collects and holds about you is obtained from a number of sources, including you, third party service providers, and third parties that you direct to provide us information.
